Free Hosting Rules

• Be respectful. To me and to other hostees. I will not tolerate any form of abuse and you will immediately be terminated if this occurs.
• I will not code your layout for you – but if you are having problems I may be able to guide you in the right direction.
• Please ensure that all scripts that you intend on using are up-to-date to keep the server secure.
• Paid advertisements will be allowed however you need to notify me first.
• You have your own responsibility to back up your files regularly. The backup service is a courtesy only.
• Domain hostees must already have purchased their own domain. I will not buy the domain for you but I can purchase it on your behalf.
• The site must be free of illegal/licensed, warez and/or any other materials considered against the law. I will not take the fall for anyone. This includes but is not limited to mp3s, video files, scans and more. You MAY link to mp3 files uploaded elsewhere.
• Hosting MAY NOT be used as a storage site. I will be checking regularly for site activity etc. Please update at least once every 2 months.
• If you are going on hiatus, please notify me and state the reason why and how long you think it will take.
• On the hosting application, please type 'Three-Words is awesome' somewhere in the application - this is to double check that you've read the rules.
• Sites MUST be in English and please, refrain from typing LiKE tHiS because it’s really hard to read. Also, try to use correct grammar.
• You must get your site up within 4 weeks (even if it’s just a banner saying ‘coming soon’). If not, please contact me and we’ll work something out. I know life can be hectic sometimes!

Modification

Three-Words reserves the right to add, delete or modify the Terms of Services at any time without notice. You agree to be bound by any changes Three-Words may reasonably make to this agreement.

I. New Accounts

Accounts will be processed after payment has been received and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is our goal to have accounts setup within 15 minutes however depending on the nature of request, it can take up to 24 hours. Please double-check your spam folders to ensure that it hasn't been misplaced before contacting us.

II. Non-Payment

Three-Words reserves the right to suspend or cancel any services due to non-payment. Any invoice that is outstanding for 10 days will be subject to a late fee of $15.00 and/or an account suspension until account balance has been paid in full. Outstanding services that are 30 days past due will be automatically terminated from our servers and will incur a $20.00 activation fee. Backups may not be available and Three-Words under no circumstances is responsible or can be liable for this data loss. If you have concerns about the status of your account or possible fault of a payment method you should contact us immediately.

III. Cancellation And Refunds

Three-Words reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.

Cancellation notices must be submitted via the cancellation form in the client area. You must complete and confirm that you are cancelling your service or you will be held liable for any charges that were invoiced to you. Selecting immediate cancellation means that your service will be cancelled and terminated 24 hours after your request. If you do not wish to cancel your service, please contact us as soon as possible. It is also your responsibiity to cancel any subscriptions you have with us and we will not be held liable if the payment is processed. No other forms of cancellation are accepted.

Three-Words provides a 30 day refund guarantee for shared web hosting clients. The refund is only eligible for first time clients. For example, if you have had an account with us before, cancelled and signed up again, you will be not eligible for a refund. The guarantee encompasses hosting services and excludes fees such as but not limited to domain costs and software licenses. For example, if a Three-Words client was to sign up annually on a 3.95 plan with a 10% discount totaling $42.66 and request a refund within thirty day window, the client would receive $32.66 to account for the free domain included.

Violations of the Terms of Service will waive the refund policy.

IV. Domains

Three-Words is not responsible for renewing the domain. Domain prices are subject to change.

V. Content

Services provided by Three-Words may only be used for lawful purposes only. The laws of the United States and Australia apply. Examples of unacceptable content but are not limited to, are listed below:

• IRC/IRC egg drops or bots
• Mail bombers
• IP spoofers
• Port scanners
• Video & Game hosting/streaming (excluding Flash & Java Games) (third party streaming is permitted)
• Adult Material (Pornographic and/or obscene content)
• Illegal distributing and/or advertising of copyrighted material
• Warez/Nulled Content
• Websites designed specifically for downloads
• Offensive, racist sites
• Scamming or Fake Websites
• Free hosting sites are not permitted

Shared/Reseller accounts must not be used as a backup/storage device.

VI. Resource Usage

In order to protect the intergrity of our services and clients, the following limitations have been placed. You may not: o Use 10% or more of system resources for longer than 60 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
• Run any software that interfaces with an IRC (Internet Relay Chat) network.
• Run any bit torrent application, tracker, or client.
• Participate in any file-sharing/peer-to-peer activities
• Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
• Run cron entries with intervals of less than 15 minutes

VII. Overages

You agree and understand that Three-Words will charge the following for overages on shared and reseller accounts: 1GB Diskspace = $2 per month over the limit ; 50GB Bandwidth = $3 per month over the limit

VIII. Zero Tolerance Spam Policy

Three-Words has a zero tolerance spam policy. We do not allow unsolicited e-mail, bulk emailing, and spam. Any user found doing duch activity will have their account terminated with or without notice. Websites that are advertised via spam may not be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated. Users will be charged a fee for blacklist removal of $250.00 or more.

IX. Backups And Data Loss

Our backup service is a courtesy service only. Three-Words is not responsible for lost material. It is highly suggested to make backups and download them to your computer. A free alternative is Comcure.

X. Uptime Guarantee

Three-Words endeavours to have network uptime 99.9% of the time on all hosting plans. In the event that we fail to deliver this, we will, at your request, credit a pro-rated amount for the duration of excessive downtime. This guarantee does not include scheduled server maintenance, downtime due to natural disaster or DDoS attacks.

XI. Free Migration Policy

Our free migration policy is only applicable to Cpanel websites.

XII. Service Refusal

We reserve the right to refuse, cancel or suspend service, at our sole discretion.
